A cork bulletin board holds an org chart of blank white cards joined by red string: one card at top, two cards below it, and five cards in the bottom row. Between the two middle cards, red string passes through two bare pinholes where a card is missing. Three loose blank cards and a closed manila envelope lie on the desk below.

What a closed session is

Texas law lets a council meet in private to deliberate the "appointment, employment, evaluation, reassignment, duties, discipline, or dismissal" of a public employee.3 The city's agenda calls this a closed executive session.2 Under state law, a final vote on a matter deliberated in a closed meeting "may only be made in an open meeting."4 State law makes each city worker's "salary, title, and dates of employment" public.5

The agenda lists Shane R. Saum as mayor and Norma Owen as mayor pro tem. The other council members are Amanda Chavarria, Jess Hall, Adam Benefield, Karen Van Ness, and Paul Prince.2 Mayor Shane Saum chaired the meeting.12

How the city got here

Our story on the conflicts at City Hall covered the changes in the city manager's office this year. Ron Joy is the city's police chief.6 On Aug. 6, the council voted 7 to 0 to appoint him acting city manager until an interim manager was named.7 On Sept. 3, it voted 7 to 0 to hire Isaac Turner as interim city manager under a contract with a search firm.6 On Sept. 28, Council Member Adam Benefield wrote in a Facebook post that the council had received Turner's resignation.8 Our later story covered what came next.

At its Oct. 1 meeting, the council voted 6 to 0 to "appoint Ron Joy as Interim City Manager." Owen made that motion, and Benefield seconded it.9 These details come from draft minutes in the Oct. 15 packet, which were up for the council's approval that night.29

The Oct. 15 agenda listed four closed-session items, including the reorganization of the city's organizational structure. The agenda said "action and/or vote may be taken" on the closed-session items.2

Oct. 15, the vote

Back in open session, the chair asked for "a review of anything that we discussed back there."10 The review said the council had received "an update regarding potential organizational chart changes from your interim city manager, Mr. Joy."11

The motion's words were "I make a motion that staff go ahead and implement as directed back in chambers in regard to personnel and their salaries."1 Mayor Pro Tem Norma Owen made the motion. Council Member Paul Prince seconded the motion.212

The chair asked, "Is there any discussion on the motion?" and then said, "Hearing none." It passed on a voice vote, with a call for ayes and then nays.12

What we could not find

  • Which jobs the changes affect, and whether any jobs were added, cut, or merged.
  • The old and new pay, and what the changes cost this year.
  • Which fund pays any added cost, and if this year's budget covers it.
  • The new staff chart the council was shown.
  • Minutes of this meeting. The city had not posted them when we wrote this.

What you can do

  • The city's records page says Texas law "gives you the right to access government records."13
  • The city takes public information requests online through NextRequest, and the city secretary's office handles them.13
  • Ask the city for the new staff chart, and each changed job's title and pay before and after.
